On April 25, 2019, the Verkhovna Rada of Ukraine adopted the Law of Ukraine “On Ensuring the Functioning of the Ukrainian Language as the State Language” 702704-VIII (hereinafter – the Law №2704-VIII).
According to the first part of Article 13 of Law 2704-VIII, the state language is the language of normative legal acts and acts of individual action, record keeping, and document circulation of state authorities, authorities of the Autonomous Republic of Crimea, and local self-government bodies.
Part 6 of Article 13 of Law 2704-VIII provides that state authorities, authorities of the Autonomous Republic of Crimea and local governments, enterprises, institutions, and organizations of state and communal ownership take into consideration documents drawn up in the state language, except as provided by law.
According to Article 10 of the Constitution, the state language in Ukraine is Ukrainian.
Part seven of Article 1 of Law 2704-VIII stipulates that the status of the Ukrainian language as the sole state language presupposes its mandatory use throughout Ukraine in the exercise of powers by public authorities and local governments, as well as in other public spheres of public life, which are defined by this Law.
The State Medical Service exercises its powers within the powers granted to it and in the manner prescribed by the laws of Ukraine, in particular, part two of Article 19 of the Constitution of Ukraine, which provides that public authorities and local governments, their officials are obliged to act only on the basis, within the powers and in the manner prescribed by the Constitution and laws of Ukraine.
Given the above, the State Medical Service emphasizes the need to comply with the requirements of Law 2704-VIII, in particular when submitting, receiving, executed documents, including those to be translated, etc.
