What is the procedure for disclosure of confidential information about the products before courts, law enforcement authorities, fiscal authorities and other public authorities, including market surveillance bodies, which became known in the course of conformity assessment?
According to expert opinion of JERELO, in accordance with the provisions of Technical Regulations, all parties that apply such Technical Regulations shall guarantee confidentiality of information obtained in the course of fulfilment of their tasks.
Subject to Clause 6 of the Specific Requirements to Designated Conformity Assessment Bodies, approved by the Decree of the Cabinet of Ministers of Ukraine on January 13th, 2016 No.56, designated body personnel shall ensure compliance with the requirements regarding confidential information that is protected as commercially sensitive information, obtained during the duty period following the relevant Technical Regulations, except for the extent when it has to be disclosed to the appropriate authorized bodies by law.
Therefore, such procedures are determined under relevant laws.
