The Government has published the text of the August resolution of the Cabinet of Ministers on the development of the emergency medical care system in 2020

Resolution of the Cabinet of Ministers № 818 “Some issues of development of the emergency medical care system in 2020” came into force on September 12, 2020.

The act, in particular, approved the list of medical devices and accessories for them, systems of medical devices, procedural kits purchased from the state budget for the development of emergency medical care in the form of product names and units without codes according to UKTZED and National Classification of Medical Devices 024: 2019.

Some items in the list contain a note *, indicating that this product may be replaced by a single medical device capable of performing similar functions. The act also approved the Procedure for the use of funds provided in the state budget for the development of the emergency medical care system.

In particular, it is determined that this Procedure determines the mechanism of use of funds provided in the state budget under the program “Development of the emergency medical care system”.

The main administrator of budget funds and the responsible executor of the budget program is the Ministry of Health.

The recipient of budget funds is the state enterprise “Medical Procurement of Ukraine”, which belongs to the Ministry of Health.

The main requirements to the technical specification for the goods that are the subject of procurement for the development of the emergency medical care system are determined by the Ministry of Health.

Procurement of specialized ambulances is carried out in accordance with the Procedure for Procurement of Goods, Works and Services Necessary for Measures to Prevent the Occurrence and Spread, Localization and Elimination of Outbreaks, Epidemics and Pandemics of Acute Respiratory Disease COVID-19 Caused by SAR, on the territory of Ukraine, approved by the resolution of the Cabinet of Ministers of Ukraine of March 20, 2020, № 225 (Official Gazette of Ukraine, 2020, № 31, art. 1074, № 31, art. 1077).

Procurement of other goods and services at the expense of budget funds is carried out in the manner prescribed by law.

Prepayment for goods and services is subject to the provisions of budget legislation. Agreements (contracts) for the purchase of goods and services may provide for advance payment for a period not exceeding two months of up to 30 percent of their value.

Separately, the resolution provides for some issues of conformity assessment of medical devices from the list № 818.
Thus, the act stipulates that the introduction within the measures for the development of emergency medical care into circulation and/or operation included in the list of medical devices, medical device systems, procedural kits, medical devices for in vitro diagnostics as part of specialized sanitary transport approved by this resolution. , in respect of which the requirements of paragraphs 15-19 of the Technical Regulation on medical devices, approved by the Cabinet of Ministers of Ukraine dated October 2, 2013, № 753 (Official Gazette of Ukraine, 2013, № 82, p. 3046), paragraphs 10-13 Technical regulations on medical devices for in vitro diagnostics, approved by the Cabinet of Ministers of Ukraine dated October 2, 2013, № 754 (Official Gazette of Ukraine, 2013, № 82, p. 3047), is allowed subject to recognition by the designated body for conformity assessment carried out by accredited foreign conformity assessment bodies in accordance with the requirements of parts one and three of Article 45 of the Law of Ukraine “On technical regulations and conformity assessment”.

Resolution № 818 obliges the Ministry of Health to submit to the Cabinet of Ministers of Ukraine and the Ministry of Finance by April 1, 2021, a report on the results of measures to develop the emergency medical care system and proposals to continue such measures in 2021.
