The Government continues its policy of deregulation and proposes to completely restart the system of business inspections. Relevant bills №5837 and №5838 have already been registered in the Verkhovna Rada of Ukraine.
The documents provide for a number of innovations aimed at reducing the administrative burden on business and stimulating the business activity of enterprises.
The key idea is to restructure the inspection system from punitive – repressive (inspection – sanction) to preventive (preventive – advisory) and reorientation of all state supervision bodies to a risk-oriented approach when planning inspections of entrepreneurs. This approach assumes that the lower the degree of risk of the entity, the less often it will be inspected and the shorter the period of inspection.
Another innovation is the institute of voluntary audit of the company, which can be an alternative to state supervision. That is, the company will be able to initiate an audit of itself. In case of violations, sanctions will not be applied, and in case of a positive conclusion – the frequency of scheduled inspections will decrease.
It is also planned to create an institute of civil liability insurance for entrepreneurs. A special law stipulates that in the case of concluding a civil liability insurance contract, companies with a medium and insignificant degree of risk will be inspected less often.
The adoption of the law will create the most transparent system of business inspections and virtually eliminate any abuse.
Thus, the document provides for a limited period for an unscheduled event to verify compliance with the requirements of the order: not earlier than the last date to eliminate the violation specified in the order or other administrative document, and not later than two months from that date. And to increase the objectivity and transparency of the consideration of complaints of entrepreneurs, public Councils on state supervision under the control bodies will be established.
Digitization and automation of data processing will also contribute to the transparency and legitimacy of all processes related to control measures.
Yes, the functionality of the Integrated Automated System is being expanded and improved. In particular, it is possible to carry out state supervision measures and exchange documents in electronic form. In addition, the interaction with the control bodies will take place through a free convenient e-office: the possibility of filing a complaint and the opportunity to refuse a comprehensive planned event through the e-system is fixed.
